Terms of Use “Levamio Is It a Scam?”

1. Scope and provider

1.1 These terms apply to the use of the app “Levamio Is It a Scam?” (called “Levamio Betrugs-Check” in German; iOS and Android, hereinafter the “App”) by all users, free of charge and with a subscription. The provider is NEXTLEVEL CORPORATE SERVICE PROVIDER - FZCO, Building A1, IFZA Business Park, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates, DIEZ License No. 67837, represented by Tassilo Peter Seitz, email: [email protected], phone: +971 58 302 5922 (“we”, “us”). Levamio is an offering of NEXTLEVEL CORPORATE SERVICE PROVIDER - FZCO.

1.2 The offering is aimed at consumers. The AI check may only be used from the age of 16; before the first check you confirm this in the App with a separate box.

1.3 Deviating terms of the user do not apply. For purchases, the terms of the respective store (Apple Media Services / Google Play) apply in addition.

2. Services

2.1 AI check: You can paste text or links or select up to 3 screenshots or photos (e.g. of a text message, email, messenger message, letter or web page). After your consent, the App sends this content to an AI service and shows an assessment as a traffic light (green: no typical warning signs detected; yellow: irregularities, please verify by other means; red: clear warning signs) with the warning signs found and general next steps.

2.2 Local link check: The App checks links and email senders on the device for typical spelling deceptions (e.g. imitated brands, mixed alphabets, Punycode, short links). It does not open any links and does not assess the content of linked pages. This feature is free of charge and can be used without consenting to the AI check.

2.3 Emergency numbers and advice: For the chosen country, the App shows general emergency and reporting numbers from a stored list. We strive for accuracy but cannot guarantee that every number is up to date; in an emergency, always use the emergency number known in your country (112 in the EU).

2.4 Tell someone you trust: If the traffic light is red, the App can create a prepared text with the warning signs found and open your phone’s share menu. You choose the recipient and trigger the sending yourself; we do not operate a sending service.

2.5 No storage: Checked content and results are stored neither on our server nor in the App (details: Privacy Policy). Keep important messages yourself (e.g. for a police report).

3. Assessment, not a guarantee – what the App does not do

3.1 The assessment is generated automatically by artificial intelligence and is labelled “Created by AI” in the App. It may be wrong or incomplete. A green traffic light does not mean that a message is genuine or harmless; a red traffic light does not mean that a scam is certain or that a sender is acting unlawfully.

3.2 The App does not replace legal advice, advice from your bank, the police or consumer advice. It does not make any decision for you. Always verify payment requests, login requests and requests for data yourself through a channel you know (e.g. the phone number on your card or the official website typed in yourself).

3.3 The App cannot prevent you from becoming a victim of fraud, cannot recover money and cannot block accounts. If you have suffered a loss, contact your bank and the police immediately.

3.4 Evaluations of senders (e.g. companies, authorities, individuals) in the assessment are indications of typical patterns in the specific message, not statements of fact about the sender. Please do not share assessments publicly as evidence against third parties.

4. User obligations

4.1 Only check content that you received yourself or that someone has given you for checking. Black out anything not needed for the check (e.g. full account numbers, health information).

4.2 It is prohibited to use the App for unlawful purposes, in particular to test or “optimise” scam messages, to check content in bulk or automatically, to circumvent protection mechanisms (allowance, device check, rate limits) or to induce the AI to produce output that violates laws or the usage policies of our AI provider.

4.3 In the event of violations, we may restrict use for the device identifier concerned; your rights as a consumer and towards the store remain unaffected.

5. Free use, subscriptions, prices

5.1 Without a subscription you can use 3 AI checks free of charge per device and calendar month (current state of the App; the display in the App is decisive). Content in which the App finds nothing to check, as well as failed checks, are not counted. Free checks require a device check (Apple App Attest or Google Play Integrity); in addition, limits per internet connection and day and an overall daily cap apply. There is no entitlement to free checks.

5.2 Plus (monthly or yearly) unlocks further checks within the scope of fair use: currently max. 8 checks per 10 minutes and 40 per day per device. The limits serve to protect against abuse and costs; they are not reached in normal private use.

5.3 Family subscription (iOS only): like Plus, shareable with up to five further members of your Apple Family Sharing group under Apple’s rules. We do not currently offer it on Android because Google Play does not support family sharing for subscriptions.

5.4 Subscriptions are concluded and paid for exclusively via the App Store or Google Play. Prices, term, automatic renewal, cancellation (no later than 24 hours before expiry in the settings of your store account) and refunds are governed by the information in the store and the store’s rules. You see the prices before purchase in the App and in the store.

5.5 We may change features, allowances and limits for the future insofar as this is reasonable for you (e.g. due to increased costs of the AI provider or to protect against abuse). Running subscriptions keep their scope of service until the end of the paid period; we will inform you of material changes in good time in the App.

6. Availability

6.1 The AI check requires an internet connection and the availability of our server and the AI provider. Maintenance, disruptions or an emergency shut-off (e.g. in case of security incidents) may temporarily prevent the check; the App then shows a notice. The local link check also works offline.

6.2 If the AI check is unavailable for a prolonged period, your rights towards the store (refund) remain unaffected.

7. Liability

7.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee assumed. We expressly do not assume any guarantee for the correctness of an assessment (section 3).

7.2 In the event of a slightly negligent breach of material obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

7.3 In particular, damage resulting from a payment or disclosure of data that you make despite the App’s advice (section 3.2) without verifying through a known channel is not typical for the contract, unless section 7.1 applies.

7.4 Mandatory consumer protection provisions of your country of residence remain unaffected.

8. Rights to the App, reports

8.1 The App, its texts, design and rules are protected by copyright. You receive a simple, non-transferable right to use the App for private purposes; in the App Store the Apple standard EULA applies in addition.

8.2 You may use the assessments for private purposes, e.g. pass them on to a trusted person.

8.3 Via “Report result” you can report wrong, offensive or dangerous results to us. We use reports for improvement; they do not establish any entitlement to a reply or correction.

9. Changes to these terms

We may change these terms for the future if features, the legal situation or service providers change. We will inform you of material changes in the App; running subscriptions keep their content until the end of the paid period. The current version is in the App and at https://levamio.com/apps/betrugs-check/nutzungsbedingungen-en/.

10. Final provisions

10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

10.2 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10.3 Should individual provisions be invalid, the remainder of the contract remains valid.
