Terms of Use – "Levamio Accessibility Check" (Shopify app)
1. Scope and provider
1.1 These terms of use govern the use by merchants of the embedded Shopify app "Levamio Accessibility Check", offered in other languages under a translated name (e.g. "Levamio Barrierefrei-Check") (the "app"). The provider is NEXTLEVEL CORPORATE SERVICE PROVIDER - FZCO, Building A1, IFZA Business Park, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates, DIEZ License No. 67837, represented by Tassilo Peter Seitz, email: [email protected] ("we", "us"). Levamio is an offering of NEXTLEVEL CORPORATE SERVICE PROVIDER - FZCO.
1.2 The app is aimed exclusively at businesses (entrepreneurs within the meaning of § 14 BGB, German Civil Code) that operate a Shopify shop ("merchants"). By installing the app, the merchant declares that it uses the app for its commercial or self-employed professional activity. Anyone who installs the app for a shop warrants that they are authorised to do so by the shop owner.
1.3 The contract of use is concluded when the app is installed in the Shopify admin. In addition, Shopify's terms (in particular the Shopify Terms of Service and the Shopify App Store terms) apply in the relationship between the merchant and Shopify. Shopify is not the provider of the app and is not responsible for it.
1.4 The merchant's general terms and conditions do not apply.
2. Services of the app
2.1 The app automatically checks product images (via the Shopify API) and the HTML and CSS of selected publicly accessible pages of the shop (home page, one collection page, one product page, cart) for common barriers using selected, automatically testable criteria of WCAG 2.2 (levels A and AA). It shows a score from 0 to 100 with a prioritised list of notes (red/yellow/green), the relevant WCAG reference, explanations and step-by-step instructions. Areas currently checked include in particular: alt texts, labelling of form fields, colour contrast (heuristic based on the theme CSS), names of links and buttons, link texts, heading structure, page language, page title, visible keyboard focus (heuristic), skip link, zoom and media (captions, autoplay, titles of embedded content).
2.2 In addition, the app offers: AI-assisted suggestions for alt texts of product images, subject to the merchant's approval; a self-assessment "Am I affected?" on the European Accessibility Act (Directive (EU) 2019/882) per target market in the EU; and, in the "Pro" plan, a generator that creates a draft accessibility statement from the merchant's details.
2.3 The app does not add any overlay, widget or script to the shop and does not change theme code. The merchant fixes barriers itself in the theme or in its content.
2.4 The scope of the "Free" and "Pro" plans is as described in the Shopify App Store and in the app at the time of booking. Even where features are described as "unlimited", reasonable technical limits apply to protect against abuse and overload (e.g. a maximum number of AI suggestions per hour); normal use of a shop is not restricted by this.
2.5 We may further develop, adapt to legal changes, add or remove audit rules, weightings and features, provided the core of the service is preserved and the change is reasonable for the merchant.
3. No legal advice, no promise of conformity
3.1 The app does not provide legal advice or legal services. It does not assess the individual case and replaces neither a review by a lawyer nor a manual accessibility test by experts or by people with disabilities. Notes, explanations, instructions and the result of the self-assessment are general information.
3.2 We do not promise that the shop is accessible or meets the requirements of the European Accessibility Act, the BFSG (German Accessibility Strengthening Act) or other laws. A high score or "green" results only mean that the app, using its methods, found no indication on the points it checks. Automated checks detect only some of the possible barriers; many criteria (e.g. keyboard operation in a flow, understandability, quality of alt texts and captions) can only be assessed manually.
3.3 Limits of the methods: The storefront check reads the delivered HTML and CSS without JavaScript and without rendering in a browser; content generated only by JavaScript and the checkout provided by Shopify are not checked. The contrast check evaluates only colour pairs that can be read unambiguously from the CSS. A sample of pages is checked. False-positive and false-negative results are possible.
3.4 AI suggestions: Alt-text suggestions are generated automatically and may be inaccurate. They are applied only after review and approval by the merchant.
3.5 Accessibility statement: The generator creates a draft from the merchant's details. The merchant reviews, completes and publishes the statement itself and is solely responsible for its content. The suggested information on national laws and authorities is non-binding guidance.
3.6 The merchant remains solely responsible for its shop, its content and their accessibility and lawfulness, including where it adopts notes, templates or suggestions from the app.
4. Billing via Shopify
4.1 The "Free" plan is free of charge. The "Pro" plan is subject to a fee (currently USD 14 per month). All fees are billed exclusively via Shopify (Shopify Billing / Managed Pricing) and appear on the merchant's Shopify invoice. Shopify displays the price, currency (currently USD), billing period and any trial periods before confirmation; this display is authoritative.
4.2 The merchant confirms the booking in the Shopify admin. Subscriptions renew automatically for the respective billing period until the merchant changes the plan or uninstalls the app.
4.3 Cancellation: The merchant ends a paid plan by switching to "Free" in the app or on the Shopify-hosted pricing page, or by uninstalling the app. Billing ends in accordance with Shopify's rules; whether and to what extent a pro-rata credit is granted is also governed by those rules.
4.4 We grant refunds only in accordance with Shopify's rules or where mandatory law requires it. Taxes are calculated in accordance with Shopify's rules.
4.5 We announce price changes with reasonable notice; they take effect only once the merchant has confirmed them in accordance with Shopify's rules or after expiry of the period provided for there.
5. Merchant's obligations
5.1 The merchant grants the app the permissions required for its use. The optional write_files and write_products permissions are needed only for applying alt texts.
5.2 The merchant enters in the app only details it is entitled to use (e.g. contact details in the accessibility statement).
5.3 If the merchant enters a storefront password, the app uses it only to fetch the merchant's own storefront.
5.4 Interfering with the app, circumventing plan limits or quotas, automated bulk requests and using the app for third-party shops without authorisation are prohibited.
5.5 The merchant itself checks the effect of applied alt texts and of changes to its theme.
6. Data and data protection
6.1 By design, the app processes no data of the merchant's end customers. Details, including on deletion after uninstallation (Shopify webhook shop/redact), are set out in the privacy policy: https://levamio.com/apps/shopify-barrierefrei/datenschutz-en/.
6.2 Where, in individual cases, we process personal data from shop content on behalf of the merchant, the data processing agreement under Art. 28 GDPR at https://levamio.com/apps/shopify-barrierefrei/avv-en/ applies; it is deemed agreed upon installation of the app without any separate request.
6.3 Alt texts that the merchant applies to the shop via the app belong to the merchant's shop and remain in Shopify after uninstallation.
7. Availability
We strive for high availability of the app but do not owe any particular availability. The app depends on Shopify APIs, webhooks and other service providers (hosting, AI provider). Scheduled audit runs may be delayed or fail; the merchant can start an audit run manually at any time.
8. Liability
8.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), where we have fraudulently concealed a defect and where we have given a guarantee. We give no guarantee of the accessibility or lawfulness of the shop (section 3).
8.2 In the event of a slightly negligent breach of material contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the merchant may regularly rely), liability is limited to the foreseeable damage typical for the contract, per incident at most to the higher of the following amounts: the fees paid by the merchant for the app in the last 12 months or USD 1,000. Otherwise, liability for slight negligence is excluded.
8.3 When using the "Free" plan, we are liable, to the extent permitted by law, only under section 8.1.
8.4 Under section 3, the app does not owe a complete accessibility audit. If it does not detect a barrier or legal defect of the shop that it cannot detect with the methods described (section 3.3), this is not a breach of duty. For costs of warning letters (Abmahnungen), contractual penalties, fines, measures by market surveillance authorities, third-party damage claims and lost profit, we are otherwise liable only under sections 8.1 and 8.2.
8.5 The limitations also apply in favour of our legal representatives, employees and vicarious agents. Claims become time-barred one year after the statutory start of the limitation period, except in the cases of section 8.1.
9. Term, termination, suspension
9.1 The contract of use runs for an indefinite period. The merchant can end it at any time by uninstalling the app. We can terminate it with 30 days' notice, for example if we discontinue the app; periods already paid are then credited pro rata in accordance with Shopify's rules.
9.2 In the event of serious breaches of these terms, we may suspend access after prior warning, and immediately in the event of particularly serious breaches.
10. Changes to these terms
We may change these terms with effect for the future if there is an objective reason (e.g. new features, change in the law, changes to Shopify's requirements). We will notify material changes at least 30 days in advance in the app or by email to the shop's contact address. If the merchant continues to use the app after the changes take effect, the changes are deemed accepted; we will point this out in the notice. If the merchant does not agree, it can uninstall the app before the changes take effect; for paid periods, section 9.1 sentence 3 applies accordingly. Changes to the main services and prices are not made in this way, but only under section 2.5 or 4.5 respectively.
11. Governing law, jurisdiction, final provisions
11.1 The law of the United Arab Emirates as applicable in the Emirate of Dubai applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where, contrary to section 1.2, a user is a consumer, this choice of law does not apply to them; the law applicable under statutory provisions applies (in particular the law of the state of their habitual residence, Art. 6(1) Rome I Regulation), and places of jurisdiction in their favour remain unaffected.
11.2 If the merchant is a registered trader (Kaufmann), a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in the EU, the place of jurisdiction for all disputes arising from this contract is Dubai, United Arab Emirates; mandatory statutory places of jurisdiction remain unaffected.
11.3 If individual provisions are invalid, the remainder of the contract remains valid; the invalid provision is replaced by the statutory rule. Where we provide an English version, the German version prevails in the event of discrepancies.
