Terms of Use “Levamio Bereavement Guide” / “Levamio Nachlass-Lotse”
This English version is provided for convenience. The German version prevails (section 12.2), without prejudice to mandatory consumer law.
1. Scope and provider
1.1 These terms apply to the use of the app “Levamio Nachlass-Lotse” (iOS and Android, also under localised names such as “Levamio Bereavement Guide”; the “app”) by all users, free of charge and with the full version. The provider is NEXTLEVEL CORPORATE SERVICE PROVIDER - FZCO, Building A1, IFZA Business Park, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates, DIEZ License No. 67837, represented by Tassilo Peter Seitz, email: [email protected], phone: +971 58 302 5922 (“we”, “us”).
1.2 The service is aimed at consumers. Businesses may also use the app; section 10.5 applies to them. The wording help (AI) may only be used from age 16.
1.3 Conflicting terms of the user do not apply.
2. Apple and Google
2.1 Purchase via the store: You buy the full version in the Apple App Store or on Google Play. The terms of Apple or Google apply to purchase, payment and refunds; the store processes the purchase and, depending on store and country, is your contractual partner for the purchase.
2.2 iOS: The Apple Standard Licensed Application End User License Agreement (Standard EULA) (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to the licence. Apple is not responsible for maintenance, support, warranty or third-party claims relating to the app; Apple and its subsidiaries are third-party beneficiaries of the Standard EULA. In case of conflict the Standard EULA prevails for the app licence; otherwise these terms apply.
2.3 Android: The Google Play Terms of Service between you and Google apply. The licence to the app follows from section 7.
3. What the app does – and what it does not
3.1 Service: The app supports relatives after a death in Germany, Austria, Switzerland and the United Kingdom with a task list ordered by time period, general information on legal and practical deadlines with sources, deadline reminders on the device, a list for contracts and subscriptions, letter templates (e.g. cancellation after a death, notification to an insurer or bank) completed on the device, an AI wording help, and sharing task progress with relatives via the device's share menu.
3.2 General information – no advice. The content is general information with sources and a date. We provide no legal, tax, probate or other advice and no legal services within the meaning of the German Legal Services Act or comparable laws. The app does not assess your individual case. Letter templates and AI suggestions are wording suggestions that you check, adapt and are responsible for. For questions about your case, a probate court, notary, solicitor, consumer advice centre or the competent authority can help.
3.3 Deadlines without guarantee for the individual case. The app shows deadlines according to general rules and calculates the earliest possible day from the dates you enter; public holidays and extensions are not taken into account. When a deadline starts in your case and whether exceptions apply depends on the individual case. If in doubt, check deadlines with the competent body. Reminders are an aid, not a promise; they depend on your device's settings, time and availability. Laws and procedures can change; the date stated in the app applies.
3.4 AI suggestions may be wrong. Suggestions of the wording help are generated automatically and labelled “Worded by AI”. Please read every letter before sending.
4. Free use and full version
4.1 Free: Task list, deadlines, reminders, contract list, sources and sharing the overview as text are free. Letter templates can be viewed and filled in free of charge.
4.2 Full version (one-off purchase): With the one-off purchase of the full version you can copy, share and save letters as PDF, use the wording help and exchange task progress as a file. No subscription and no automatic renewal is created. Fair use applies to the wording help; to prevent abuse currently at most 10 requests per 10 minutes and 40 per day. The store shows you the price and conditions before purchase; that offer is decisive. Prices include statutory VAT.
4.3 Restore: You can use a purchase on further devices with the same store account via “Restore purchase” where the store permits.
5. Withdrawal and refunds
The rules and procedures of the store you bought from apply to your statutory right of withdrawal and to refunds (Apple: https://reportaproblem.apple.com; Google Play: order history). Your statutory consumer rights remain unaffected.
6. Consent and data protection
6.1 Before a letter text is sent to our server and our AI provider, we obtain your express consent. Without consent the wording help cannot be used; the rest of the app remains fully usable.
6.2 Details are set out in the privacy policy: https://levamio.com/apps/nachlass-lotse/datenschutz-en/.
7. Licence and obligations
7.1 We grant you a simple, non-transferable right to use the app for your own affairs and those of your family. You may not offer the app's services commercially to third parties as your own service. You may freely use letters you create with the app.
7.2 In particular, automated mass requests, circumventing usage limits, attempts to make the AI produce output outside its purpose, and interference with the app or server are not permitted.
7.3 In case of violations we may restrict use of the wording help after prior warning, in serious cases immediately. Your rights against the store remain unaffected.
8. Availability, content and changes
8.1 The wording help requires an internet connection and the availability of our server and our AI provider. We do not owe uninterrupted availability. The other features work offline.
8.2 We maintain the content and update it with app updates. We may update, change or replace the app (e.g. other AI models, new countries or languages) where necessary for accuracy, security or further development and the agreed scope of service is not impaired for you more than insignificantly. Statutory rules on changes to digital products apply to further-reaching impairments (Sec. 327r German Civil Code). We provide updates needed to keep the app in conformity in accordance with the law (Sec. 327f German Civil Code).
8.3 Statutory rules on digital products apply to defects (Secs. 327 et seq. German Civil Code) insofar as applicable to the contract with us.
9. Your own responsibility
Decisions you make on the basis of the app (e.g. accepting or disclaiming an inheritance, cancelling contracts, letting deadlines pass) are your own responsibility. Please clarify important points with the competent body or an adviser.
10. Liability
10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under mandatory product liability law and insofar as we have given a guarantee or fraudulently concealed a defect.
10.2 For slightly negligent breach of material contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), liability is limited to the foreseeable damage typical for the contract. Otherwise liability for slight negligence is excluded.
10.3 Sections 10.1 and 10.2 also apply to free use.
10.4 The limitations under 10.2 also apply to our legal representatives and vicarious agents. Mandatory statutory rights, in particular mandatory consumer protection rules of your country of residence, remain unaffected.
10.5 Towards businesses, liability under 10.2 is additionally limited to the purchase price of the full version, at least EUR 100.
11. Governing law and jurisdiction
11.1 Consumers: We do not agree a governing law with consumers. The law applicable under statutory rules applies; for consumers in the EU in particular the law of the state of their habitual residence (Art. 6(1) Rome I Regulation), for consumers in Switzerland under Art. 120 PILA, for consumers in the United Kingdom under the rules applicable there. Businesses: The law of the United Arab Emirates as applicable in the Emirate of Dubai applies, excluding the UN Convention on Contracts for the International Sale of Goods.
11.2 Consumers may bring claims before the courts of their country of residence; we can only sue consumers there. We do not agree a place of jurisdiction with consumers. If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Dubai, United Arab Emirates.
11.3 Consumer dispute resolution: We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. For complaints please contact [email protected].
12. Changes to these terms, language, contact
12.1 We may change these terms for future contracts. For existing contracts, changed terms only become effective if you expressly agree; silence or mere continued use does not count as agreement.
12.2 The German version of these terms is authoritative. Translations are provided for understanding; mandatory consumer protection rules remain unaffected.
12.3 If individual provisions are invalid, the remainder of the contract remains valid; the statutory provision takes the place of the invalid one.
